From the teachings and advice of the Infallibles to their followers, it is clear that Shiites have two main duties during the occultation period: First, disbelief in the tyrant and refusal to turn to the tyrant and consider it forbidden. Second: turning to Islamic scholars and mujtahids to obtain religion and resolve their conflicts through their rulings as the deputies of the Imam and their argument against the people. The result of these two duties was the formation of a meaningful relationship between the people and the mujtahids and the institution of authority, which could be the source of great social changes and the cause of great revolutions, as happened during the Tobacco Movement, the demand for constitutionalism, and the Islamic Revolution. On the other hand, scholars and religious experts also have a heavy mission during the occultation of the Imam. In addition to explaining the teachings and rulings of religion to the people and guiding them to avoid the tyrant and accompany the general deputies of the Imam, they can lead the social system of Islam with the power of the people and establish the foundations of Islamic civilization. The important point is that the formation of the Islamic political system requires a profound and fundamental transformation in jurisprudence, and that is the transition from traditional jurisprudence to governmental and system-building jurisprudence. When we see Imam Khomeini’s lofty view of jurisprudence and the concept of ijtihad, we understand very well that with this deep understanding of jurisprudence, he was able to systematize and enter into civilization-building. The purpose of this article is to answer this fundamental question: What stages and developments has the theory of the guardianship of the jurist gone through throughout the history of Shiite political jurisprudence so that it has been able to act as a revolutionary and formative theory of the political system? This article is based on a descriptive-analytical method and is compiled within the theoretical framework of the necessity of the state in Islam.
